1. About these Terms

1.1 Subject matter
These Terms and Conditions (“Terms”) set out the conditions under which we provide the MOCEAN Car Subscription and the related digital and personal mobility services (together, the “MOCEAN Car Subscription”).

1.2 Please read carefully
Please read these Terms carefully before registering for our services. They explain who we are, how we provide our services, how you and we may amend or end the contract, what to do if a problem arises, and other important information.

2. Information about us and how to contact us

2.1 Who we are
We are Hyundai Connected Mobility GmbH (“we” or “us”), a company registered in Germany. Our VAT number is DE364376196 and our registered office is at Kaiserleipromenade 5, 63067 Offenbach.

We provide the services described in these Terms under the MOCEAN brand.

2.2 How you can contact us

2.3 How we may contact you
If we need to contact you, we will do so by telephone or in writing to the email address or postal address you provided when placing your order.

2.4 “Written” includes email
References to “in writing” in these Terms also include email.

3. Our contract with you

3.1 Services provided
The MOCEAN Car Subscription allows you to rent a vehicle from our fleet (the “Rental Vehicle”) for your personal use and to use associated mobility services (the “Services”).

Our offers can be viewed at www.mocean-auto.de, where you may select the services that suit you. Our website and all related digital interfaces are referred to as the “Platform.”

The chosen offer includes details of your Rental Vehicle model, rental duration, and other key information, as set out in Appendix 1.

3.2 Territorial restriction
We only offer our services to individuals residing in Germany. Our promotional materials and Platform are solely intended to advertise services offered in Germany.

3.3 Registration
To use our services, you must apply for a MOCEAN Car Subscription via our Platform (“Registration”). You must first create a personal account (“Your Account”) and provide us with certain information, including a copy of your driving licence and ID card.

3.4 Order details
You will then select the details of your subscription, including vehicle, mileage, price, payment method, delivery date, and duration. These details will be listed in your order summary.

3.5 Application and acceptance
If the details are correct, you may submit your application. By doing so, you agree to the contents of the order summary and these Terms, including our right to verify your information and check your creditworthiness (see Section 4).

A contract is formed once we confirm your application in writing.

3.6 Refusal
If we cannot accept your application, we will inform you. No contract will be formed in that case.

4. Eligibility criteria and verification process

4.1 Eligibility requirements
To obtain a MOCEAN Car Subscription, you must:
a) be aged between 21 and 71;
b) have held a valid EU driving licence for at least 36 months;
c) reside in Germany;
d) be creditworthy (positive credit check).

4.2 Registration checks

You must provide the following:

  • Personal details: name(s), surname, date of birth.
  • Contact details: current postal address, email, telephone number.
  • Copies of your driving licence and ID card (uploaded via the Platform).

4.3 Verification
We will verify your data and creditworthiness. We may request additional documents.

4.4 Credit check
A third-party credit agency will perform the check, subject to your consent. Depending on the outcome, we may require a security (e.g. deposit or guarantee).

4.5 Data protection
Information on how we process your data is set out in our Privacy Policy.

4.7 Rejection
We may reject applications for legitimate reasons.

4.8 Additional drivers

The same eligibility requirements apply. Each must:

  • Provide a copy of their valid driving licence.
  • Live in your household and be registered at your address.
  • Be one of up to four named additional drivers.
  • You remain the main driver and are responsible for ensuring compliance.

4.9 Duty to notify
You must inform us promptly of changes affecting eligibility (e.g. loss of licence, new address).

4.10 Ongoing checks
We may re-check eligibility during the contract. If criteria are no longer met, we may terminate in accordance with Section 12.

5. Rental vehicles and order summary

5.1 Our rental vehicles may differ from the images shown. The images of rental vehicles are provided for illustration purposes only. Our rental vehicle offering includes both new and used vehicles, which may show signs of use upon delivery. The guaranteed features of the rental vehicles are limited to the specifications listed in the order summary.

5.2 Each MOCEAN Car Subscription has a minimum term, which you select at registration. This term begins on the day the rental vehicle is handed over to you.

5.3 A MOCEAN Car Subscription has a maximum duration of 24 months. This means your contract with us will end no later than 24 months after delivery of the rental vehicle.

Once this maximum period expires, your contract ends automatically. The provisions of Section 11 regarding termination of the contract and return of the rental vehicle apply.

5.4 If you have not chosen a minimum term of 24 months, your MOCEAN Car Subscription will automatically renew on a monthly basis after the minimum term expires, up to the maximum contract duration.

After the minimum term, you may continue to use your vehicle (see Section 5.5) or exchange it for another vehicle (see Section 6.1).

5.5 After the minimum term, you may terminate our services at any time by providing 30 days’ written notice. Your MOCEAN Car Subscription ends 30 days after we receive your written notice. In the event of termination, we will charge you a prorated subscription fee up to the end date of your MOCEAN Car Subscription.

5.6 To notify us of non-renewal or termination of your contract, please use the following email address:

5.7 We may require you to return your rental vehicle and exchange it for another of our models in the same or a higher category:

a) If the minimum contract term exceeds 6 months, we may request a vehicle exchange at any time after the first 6 months. In such cases, we will notify you at least 30 days in advance and provide details of your new rental vehicle.

b) In the event of damage to your rental vehicle, we may arrange an immediate vehicle exchange, regardless of your contract term.

In this case, we will notify you as quickly as possible and provide details of your new rental vehicle.

5.8 As part of any vehicle exchange initiated by us, we will prepare a handover report for your original rental vehicle and a handover report for your new rental vehicle, as described in Section 8. For clarity, a vehicle exchange does not extend the subscription term.

5.9 Please note that the rental vehicle may be equipped with tracking devices, which allow us to access the vehicle’s location data at any time. Further details are provided in the Privacy Notice.

6. Your Right to Make Changes During the Term

6.1 If your MOCEAN Car Subscription has a minimum term of more than 6 months, you may request an exchange of your rental vehicle for another one of our rental vehicles after the first six months. Vehicle exchange is subject to availability, and we may require you to complete the verification process described in Section 4 again. For clarity, a vehicle exchange does not extend the duration of your MOCEAN Car Subscription.

6.2 If the duration of your MOCEAN Car Subscription allows, you may request a vehicle exchange at regular intervals of at least 6 months.

6.3 You can request a vehicle exchange via the MOCEAN website.

As part of the vehicle exchange, we will prepare a handover report for your original rental vehicle and a handover report for your new rental vehicle, as described in Section 8 below.

6.4 A vehicle exchange may result in an adjustment of your monthly subscription fee. The applicable rental price for the vehicle you choose is the price shown on our website at the time you submit your request for exchange.

The monthly fee, as well as details of any additional costs for delivery and transfer (as set out in Annex 2), will be included in your updated contract.

6. Your Right to Make Changes During the Term

6.1 If your MOCEAN Car Subscription has a minimum term of more than 6 months, you may request an exchange of your rental vehicle for another one of our rental vehicles after the first six months.

Vehicle exchange is subject to availability, and we may require you to complete the verification process described in Section 4 again.

For clarity, a vehicle exchange does not extend the duration of your MOCEAN Car Subscription.

6.2 If the duration of your MOCEAN Car Subscription allows, you may request a vehicle exchange at regular intervals of at least 6 months.

6.3 You can request a vehicle exchange via the MOCEAN website. ​

7. Prices, Terms, and Payment for Our Services

7.1 Where to find our prices. The prices for our services can be found on our platform at www.mocean-auto.de. The monthly fees applicable to your selected services, any discounts, and additional costs (see Annex 2) are summarised in the order overview before the contract is concluded.

7.2 Contract renewal after the minimum term. In the event of a contract renewal after the minimum term, we reserve the right to amend the terms of the contract, including the monthly fees, by notifying you at least one month in advance via email. If you do not agree to the amended terms, you have the right to terminate the contract before the changes take effect. No cancellation fee will be charged in this case.

7.3 Insurance included. The MOCEAN Car Subscription includes comprehensive MOCEAN insurance. The terms and conditions of the MOCEAN insurance can be viewed on our website at . The insurance premium is included in the monthly fee.

7.4 Payment method. The fee for the first month of your MOCEAN Car Subscription will be charged shortly before vehicle handover. All subsequent monthly fees will be automatically invoiced on the first day of each monthly interval from the delivery date of your rental vehicle (unless that day falls on a weekend or public holiday, in which case the charge will be made on the next working day). Payments will be collected using the payment method you selected and the payment details you provided during registration.

7.5 Accepted payment methods. We require that you pay the monthly fees using a debit or credit card accepted by us and registered in your name. If your debit or credit card expires, you are obliged to update your payment details in accordance with Section 3.6 above. You must also ensure that sufficient funds are available in your account.

7.6 Payment processing. Payment transactions are handled by a third-party provider engaged by us, who is duly authorised to provide payment services in Germany. For this purpose, we will transmit personal data to this third party. Further details can be found in the Privacy Policy.

7.7 Digital invoices. We will provide you with digital invoices for each monthly fee. These invoices will be made available in your personal area on our website for download, or, if this is not possible, they will be sent to the email address you provided during registration.

7.8 Invoice disputes. If you believe your invoice is incorrect, please contact us immediately in writing and explain the reason.

7.9 Excluded costs. The monthly fees do not include costs for fuel, parking fees, or tolls. These costs are non-refundable. Charging costs are only included in the monthly fees if explicitly agreed in writing.

7.10 Missed payments. Failure to make payments may affect your credit rating and make it more difficult for you to obtain credit in the future. Any costs we incur as a result of non-payment must be reimbursed by you.

8. Delivery and Return of the Rental Vehicle

8.1 Vehicle delivery. If delivery through a MOCEAN partner has been agreed, you must collect your rental vehicle on the date confirmed by us via email. You may collect your vehicle from the MOCEAN partner you selected during registration. The name and address of your MOCEAN partner are listed in the order overview. There is no charge for this type of vehicle handover. Alternatively, you may have the rental vehicle delivered to your home for an additional fee (see Annex 2).

8.2 Vehicle handover process. Delivery of the rental vehicle to you includes the following steps:

a) Identity check. At handover, your identity and driving licence will be checked. Please ensure that you bring your driving licence and national ID card to the handover, and that the contract signatory is present. We reserve the right to terminate this contract if you fail to present the required documents or if they do not match those submitted during registration. In such cases, Section 12 applies.

b) Vehicle inspection. Together with you, we will carry out a visual inspection of the vehicle and document any visible defects. Our representative will create a digital handover report. To complete the handover, you must confirm the accuracy of the report by providing a digital signature. The report will be available in your account and/or sent to you by email if it cannot be uploaded to your account.

c) Keys. For security reasons, the vehicle will only be handed over with one key. If the key is lost or misplaced, you must contact MOCEAN Customer Service at 📧 kundenservice@MOCEAN-auto.de. A replacement key will be ordered from an authorised dealer, and the costs must be borne by you.

d) Delays in delivery. If it becomes apparent to us that a delivery date and/or location cannot be met, we will notify you as soon as possible and inform you of the new expected date and/or location. If the delay between the originally agreed delivery date and the new delivery date is more than three weeks, you have the right to withdraw from the rental contract free of charge.

e) Failure to appear. If you do not collect your rental vehicle, or if you fail to appear at the agreed time and place for handover without notifying us at least 48 hours in advance, you must reimburse us for any resulting costs (e.g., parking or storage costs). In addition, we will charge you a contractual penalty for non-appearance in accordance with Annex 2. Both you and we retain the right to prove higher or lower actual damages.

8.3 Vehicle return. When you return your rental vehicle to us—whether for a vehicle exchange or at the end or termination of the contract—the following process applies:

a) The vehicle must be returned to the same MOCEAN partner from which you originally collected it. If the vehicle was delivered to you, you may return it to another partner designated by us.

Alternatively, you may arrange—by separate agreement—for collection by one of our drivers at another (preferred) return location within Germany, subject to an additional fee (see Annex 2).

b) You must return the rental vehicle with the same fuel level or battery charge as at the time of delivery.

c) Our representative handling the return will inspect the rental vehicle and record in the return protocol: any damage present at the time of return (including missing accessories that were present at handover), any improper use of the rental vehicle in accordance with Section 9.1 below, and the odometer reading.

d) Based on the findings under point c) above, our representative will create a digital return report. To complete the return, you must confirm the accuracy of the return report with a digital signature.

Our representative cannot provide you with a cost estimate at the time of return. Instead, the return report will be available in your account or sent to you via email within 10 days if it cannot be uploaded.

Should there be delays in providing the return report, including costs for damages, we will contact you as soon as possible.

8.4 Damage and additional charges. We will invoice you for all damages, improper use, missing accessories, or excess mileage (i.e. any mileage beyond the maximum mileage specified in the contract confirmation) noted in the return report. Certain specific components of return-related damages are listed at the end of this contract under the heading “Fees and Costs.”

You will receive an invoice for return-related damages, calculated based on the total repair costs plus an administrative fee (see Annex 2). This amount will be collected via the payment method you provided.

8.5 Refunds. Refunds of fees will not be issued in the event of late vehicle collection or early vehicle return.

8.6 Failure to return. If you fail to return your rental vehicle—even after we have expressly requested its return within a set period—or if you do not appear at the agreed time and location for vehicle return without notifying us at least 48 hours in advance, you must reimburse us for the resulting costs (e.g., driver service, administrative costs, and any further damages).

In addition, we will charge you a contractual penalty for non-appearance in accordance with Annex 2. Both you and we retain the right to prove higher or lower actual damages.

8.7 Vehicle tracking. Please note that the rental vehicle may be equipped with tracking devices that allow us to access the vehicle’s location data at any time. Further explanation is provided in the Privacy Policy.

9. Your Responsibilities and Liability

9.1 Rules for use of the rental vehicle. When using and operating the rental vehicle, you must observe the following rules:

a) You must not drive the rental vehicle under the influence of alcohol, drugs, medication, sedatives, or any other substances that may cause drowsiness or impair your ability to drive, or while undergoing medical treatment that prohibits or impairs driving, as described in the order overview.

b) You must not drive the rental vehicle without a valid driver’s licence or while subject to a driving ban.

c) You must not use the rental vehicle in violation of applicable road traffic regulations and passenger safety requirements, including rules on the use of seat belts and child seats.

d) You must not allow any third party to drive the rental vehicle, except for up to four additional drivers named in the contract.

e) You may only transport dogs or other animals if they are kept in a cage. If traces of animal hair are found upon return of the vehicle, a cleaning fee may be charged in accordance with Annex 2.

f) Smoking is prohibited in the rental vehicle. This includes vaping and the use of other tobacco products. If traces of smoke are found upon return of the vehicle, a cleaning fee may be charged in accordance with Annex 2.

g) You may only drive the rental vehicle on roads open for public use. Driving on unpaved or otherwise poorly maintained roads that could endanger the safety of the rental vehicle (including racetracks) is not permitted.

h) You must not use the rental vehicle for races, competitions, or challenges of any kind.

i) You must not transport the rental vehicle by airplane or truck.
j) You must not operate the rental vehicle contrary to the specifications in the owner’s manual.

j) You must not intentionally damage the rental vehicle, alter its technical properties, or carry out modifications of any kind (including applying stickers or wraps).

k) The transport of illegal, toxic, flammable, or otherwise hazardous substances in the rental vehicle is prohibited.

l) You must not use the rental vehicle for commercial passenger transport, nor use the rental vehicle or our platform for profit-making purposes, including ride-sharing or sharing platforms.

m) You must not use the rental vehicle to provide driving lessons.

n) You must not assign, lease, sublease, rent, pledge, sell, or otherwise use the rental vehicle as collateral or security.

o) You must not leave the rental vehicle unlocked. When leaving the vehicle, ensure that it is locked, the alarm is set, and all windows are closed.

9.2 Vehicle maintenance. You are responsible for the regular upkeep of your rental vehicle and must ensure that it is roadworthy at all times.

You must check and refill all fluids (oil, coolant, etc.) as required. Refill fluids must be approved by the vehicle manufacturer in accordance with the supplied vehicle documents.

Costs for refill fluids, as well as damages caused by the use of unauthorised fluids, are not included in the scope of the MOCEAN Car Subscription.

9.3 Scheduled servicing and inspections. You are responsible for ensuring that maintenance and inspection work on your rental vehicle is carried out in accordance with the service and inspection intervals set by the manufacturer (e.g., as stated in the owner’s manual).

The costs for such maintenance and inspection are covered under your contract, provided they are carried out by a MOCEAN partner.

Our Customer Service will provide you with the contact details of the nearest MOCEAN partner, where you must book a service or maintenance appointment to ensure roadworthiness and preserve the vehicle’s warranty.

Failure to comply with prescribed intervals may result in the loss of manufacturer warranty, in which case we will hold you liable and claim damages.

9.4 Accidents, breakdowns, or theft. In the event of an accident, breakdown, or theft of your rental vehicle, you must notify our Customer Service in writing as soon as possible and no later than within 24 hours.

Customer Service will provide you with a reporting form or a link for submitting an electronic damage report.

If damage is not reported in time, the full repair costs will be charged to you. In addition, you must promptly notify all relevant authorities (e.g., law enforcement) and cooperate in clarifying the incident by providing any required statements or explanations of the circumstances, and, where applicable, share the case reference number.

9.5 Accident repairs. If your rental vehicle sustains accident damage, you must arrange an appointment with a MOCEAN partner designated by us. Contact Customer Service at +49 69 271472420 to obtain the partner’s contact details.

9.6 Fines, tolls, and fees. You are responsible for paying all fines, tolls, and other charges incurred by you, your vehicle, or your additional drivers under the MOCEAN Car Subscription, directly to the relevant authorities.

In the event of a fine, you acknowledge and agree that we may pass your data to the police or relevant authority, who may then contact you directly.

We are not liable for increased fines, tolls, or fees resulting from notices being sent to an outdated address. It is your responsibility to inform us of any change of address to ensure timely delivery of such notices.

9.7 Reimbursement of fines and fees. If we are charged a fine, toll, fee, or administrative charge that you or an additional driver is responsible for, we reserve the right to charge you the corresponding amount.

If you fail to pay such a fine or fee, we may pay it ourselves and subsequently reclaim the amount from you, plus an administrative fee (see Annex 2), unless you can demonstrate that no or significantly lower costs or damages were incurred. This is without prejudice to our right to claim higher damages.

9.8 Insurance obligations. You must familiarise yourself with the terms of the MOCEAN insurance coverage. A link to the valid insurance policy is included in your contract confirmation.

9.9 Travel outside the EU. If you wish to use the rental vehicle outside the EU, you must inform us at least 10 working days before departure.

9.10 Liability for damages. You are liable under general liability principles for all damage to the vehicle (e.g., damage caused by shifting loads, incorrect refuelling, engaging the wrong gear, twisting damage, operating errors, or vehicle overloading), loss of the vehicle, or breaches of contract caused by you and/or an additional driver.

9.11 Exclusion of liability. You are not liable for accidents or damages caused by us. You are liable for accidents or damages caused by you or your additional drivers. If these are covered by the MOCEAN insurance, your liability is limited to the deductible specified in Annex 2.

9.12 Accessories. In the event of culpable loss or damage to accessories listed in Annex 2, you will be charged the replacement costs plus an administrative fee (see Annex 2), unless you can demonstrate that no or significantly lower costs or damages were incurred.

10. Our Liability for Losses or Damages You Suffer

10.1 Foreseeable losses and damages. We are liable to you for foreseeable losses and damages caused by us. If we fail to comply with these terms, we are responsible for losses or damages you suffer that are a foreseeable result of our breach of this contract or our failure to exercise reasonable care and skill.

However, we are not liable for losses or damages that are not foreseeable. Losses or damages are considered foreseeable if it is obvious that they will occur, or if both we and you knew they might occur at the time the contract was made, for example, if you discussed them with us during the sales process.

Our obligation to provide and deliver the vehicle lapses if and to the extent that we are not supplied by the vehicle supplier, provided that we are not responsible for the reasons for non-delivery, we inform you of the unavailability without delay, and we have not expressly assumed a special procurement risk.

In this case, your obligation to provide counter-performance also lapses, and we will immediately refund any advance payments you have made, such as deposits or delivery costs.

10.2 Liability that cannot be excluded. We do not exclude or limit our liability to you in cases where doing so would be unlawful.

This includes, among other things, liability for death, personal injury, or harm to health caused by our negligence or the negligence of our employees, agents, or subcontractors, as well as liability for fraud or fraudulent misrepresentation.

11. Termination of the Contract

11.1 Your right to terminate. You may terminate your contract as follows:

a) You may terminate at or after the end of the minimum term by sending us a notice of non-renewal or termination in accordance with Section 5.4.

b) You are also entitled to terminate the contract before the end of the minimum term with 30 days’ notice (“early termination”).

In the case of early termination, you agree to pay us a cancellation fee in accordance with Annex 2, unless you can demonstrate that no or significantly lower costs and/or damages have been incurred.

This is without prejudice to our right to claim higher damages or losses.

Your right to terminate the contract immediately for good cause remains unaffected.

11.2 Our right to terminate. We are entitled to terminate the contract for good cause with immediate effect, in particular:

a) If your driving licence is revoked by an authority, or if you otherwise no longer possess a valid driving licence.

b) If you breach material provisions or conditions of this contract, or no longer meet the eligibility criteria for our services.

c) If you fail to make a due payment even after receiving reminders from us.

d) In the event of pricing or product errors that became part of your contract confirmation.

e) If you do not collect your rental vehicle within 48 hours of our request at the collection location in accordance with Section 9.3.

f) If you no longer reside in Germany.

If costs arise for us due to early termination, we reserve the right to recover the contractual and statutory claims to which we are entitled, in particular as set out in Section 12.2.

11.3 Age limit. Your MOCEAN Car Subscription will automatically end upon your 72nd birthday.

12. Procedure upon Termination of Our Contract

12.1 Vehicle return. Upon termination or expiry of this contract—regardless of the reason for termination—the vehicle return procedure set out in Sections 8.3 and 8.4 shall apply.

12.2 Additional charges. In addition to any return-related damages you may owe us under Section 8.4, or any no-show penalties you may owe us under Sections 8.3 and 8.6, we may also charge you for any damages arising from early termination under Section 11.

We will send you an invoice for all amounts due under this Section, and the total amount will be collected using the payment method you provided.

14. Other Important Terms

14.1 Severability. If a court declares any part of this contract unlawful, the remainder shall remain unaffected. Each paragraph of these terms applies separately. If a court or competent authority decides that any provision is unlawful, the other provisions remain fully valid and enforceable.

14.2 Assignment. We are entitled to assign payment claims and other receivables against the customer, individually or in total, to a third party (e.g., a financing partner, debt collection agency).

If payment claims against the customer are assigned to a third party, we may require the customer to make payments exclusively to that third party and to issue a SEPA direct debit mandate to the third party for collection.

The customer is not entitled to assign their rights arising from the contractual relationship with us to a third party unless we have given prior written consent. Section 354a of the German Commercial Code (HGB) remains unaffected.

In compliance with data protection laws, we are entitled to provide the third party with the documents and information necessary to enforce the assigned claims, provided a data protection legal basis exists, in particular the customer’s consent in accordance with Article 7 GDPR.

14.3 Vouchers and discount campaigns. Vouchers and discount promotions apply during the periods communicated electronically. If no period is specified, they are valid for one year from the date of issue.

14.4 Governing law and jurisdiction. This contract is governed by the laws of the Federal Republic of Germany. You may bring legal action regarding the products before the competent…

Included in the monthly fee:

  • Monthly mileage allowance (which can be increased by paying the additional charge specified in Annex 2)

  • A roadside vehicle will be provided in the following instances:
    • Roadside assistance in the event of incidents or accidents where the vehicle is not roadworthy.
    • Replacement vehicles for scheduled repair or maintenance appointments are not part of the contract confirmation. Instead, a pick-up and delivery service will replace the rental vehicle for one day.
    • Category, brand, and configuration of the replacement vehicle are subject to availability. If roadside assistance is used, the conditions of the respective insurer apply.
  • Vehicle exchange after 6 months of minimum contract duration (as described in the General Terms and Conditions, plus transfer costs).

Not included in the monthly fee:

  • Repairs for tyre damage
  • Consumables (e.g., windscreen washer fluid or oil) and wear parts (e.g., wiper blades) not covered by scheduled maintenance.
